Copyright Complaint Procedure

Stampora prints personalised cards from images supplied by customers. If you own a copyright and believe your work has been uploaded or printed without permission, this page tells you how to complain and what happens next.

Who this is for

Use this procedure if you are the owner of a copyrighted work, or a person authorised to act on the owner’s behalf. If your concern is a trademark, a team or league mark, a personal likeness, or a photograph of you or your child, use the reporting route in the Acceptable Upload and Intellectual Property Policy instead. Both routes reach the same team, but a copyright claim is handled under the steps below.

Where to send a complaint

Email info@stampora.us with the words Copyright Complaint in the subject line.

Postal notices can be sent to the designated agent for OMNICARD GLOBAL LLC at 301 Prior St W, Cedartown, GA 30125, United States. If you need to speak to someone about a live complaint, call +1 (458) 245-7374. Email is the fastest route and is the one Stampora recommends.

What your complaint must contain

A complaint is only actionable if it identifies the work and the use. Include all of the following.

  1. Your full name, postal address, email address and telephone number.
  2. Identification of the copyrighted work you say has been infringed. Where you are complaining about several works, a representative list is acceptable.
  3. Identification of the material you say is infringing, with enough detail for Stampora to locate it. A page URL, a product image, an order number or a screenshot with a date all help.
  4. Evidence of ownership, or of your authority to act for the owner. A registration record, an original file with metadata, a publication date or a licence chain are all useful.
  5. A statement that you believe in good faith that the use complained of is not authorised by the copyright owner, its agent or the law.
  6. A statement that the information in the complaint is accurate, and that you are the owner or are authorised to act on the owner’s behalf.
  7. Your physical or electronic signature.

Incomplete complaints are not ignored, but they slow everything down. Stampora will write back and ask for the missing parts.

What happens after you complain

Removal at step 2 is a precaution. It is not a finding that infringement occurred, and it is not an admission of liability by Stampora or by the customer.

If your order is affected

If you are the customer whose upload has been removed, the order is held rather than cancelled while the complaint is reviewed. If the complaint is not upheld, the order resumes and you are emailed. If the complaint is upheld, the order is cancelled. Where production had not started, you are refunded. Personalised goods cannot be cancelled once production starts, and where a breach of the upload policy is confirmed after production has started, Stampora may cancel without a refund.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to info@stampora.us with the words Counter Notice in the subject line. Include:

  • Your full name, postal address, email address and telephone number.
  • Identification of the material that was removed and where it appeared before removal.
  • A statement, under penalty of perjury, that you believe in good faith the material was removed as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the courts where you are located, or where Stampora is located if you are outside that country, and that you will accept service of process from the complainant.
  • Your physical or electronic signature.

A valid counter-notice is forwarded to the complainant. If the complainant does not tell Stampora that they have started a court action within the period the applicable law allows, the material may be restored.

Repeat infringers

Stampora keeps a record of upheld complaints against each account. Accounts with repeated upheld complaints are refused further orders. Stampora may also decline a single order outright where the breach is obvious and serious.

False complaints

A complaint made in bad faith, or a counter-notice made in bad faith, can carry legal consequences for the person who made it, including liability for costs and damages. Do not use this procedure to remove a competitor, to pursue a private dispute, or to claim work you do not own. If you are unsure whether you hold the rights, take advice before you send anything.

Records and privacy

Complaints, counter-notices and the correspondence around them are kept as a record of how each matter was handled. Your contact details are shared with the other side of the dispute, because a complaint cannot be answered without them. Do not include information in a complaint that you are not willing to have passed on.

Complaint questions

How fast will my material be taken down?

Matching public listings and artwork are removed promptly after your complaint is acknowledged, which is stated as within 2 business days (provisional, pending supplier confirmation).

Will the customer see my name?

Yes. A copy of your complaint, including your contact details, is sent to the uploader so they can respond.

My complaint is about a team logo, not a photograph.

Send it through the takedown route on the Acceptable Upload and Intellectual Property Policy page. It reaches the same team.

Can a card that was already delivered be recalled?

No. A delivered card cannot be recovered, but the artwork is deleted and will not be reprinted.

What if I disagree with the outcome?

Reply with further evidence and the matter will be looked at again. Nothing here limits your right to pursue the dispute in court.
